Madras High Court Slams CCI for Lack of Transparency

In a landmark ruling, the Madras High Court has quashed the Competition Commission of India (CCI) investigation against MRF, a leading tyre manufacturer, due to a lack of prior notice before implicating it as a party under investigation. Originally, MRF was drawn into an inquiry targeting J K Tyre, where MRF’s input was sought as a ‘third party.’

The court criticised the CCI for its ‘considerable opaqueness’ in proceedings, emphasising that transitioning MRF’s status from a third party to an entity under investigation without appropriate notice carries serious implications. ‘Clearly, the proceedings lack transparency,’ the court observed, insisting that MRF should have been notified beforehand. The judgement further demands that the CCI provide a ‘speaking order’ justifying such decisions.
