Delhi High Court Resolves 40-Year Trademark Battle: Victory for PM Diesels

Delhi High Court ends 40-year dispute, favoring PM Diesels in trademark battle over ‘Field Marshal,’ setting precedent for IP protection. In a landmark decision, the Delhi High Court has put an end to a 40-year-old legal battle over the trademark ‘Field Marshal’. The case, brought forth by PM Diesels Private Limited in 1985, sought to stop Thukral Mechanical Works from using any mark resembling ‘Fieldmarshal’ after alleging trademark infringement.

Justice Prathiba M Singh, presiding over the case, ruled in favor of PM Diesels, affirming their status as the original user of the trademark ‘Fieldmarshal’ for diesel oil engines, centrifugal pumps, monoblock pumps, submersible pumps, and related products since August 1965.

The court dismissed a counter-suit filed in 1992 by Sunita Rani and invalidated Thukral Mechanical Works’ trademark registration. Furthermore, it directed the registration of PM Diesels’ trademark applications in various languages.

‘The battle between P.M. Diesels and Thukral Mechanical Works has been a long-drawn battle spanning over 40 years,’ remarked the court, highlighting the significant financial and resource burdens endured by PM Diesels throughout the litigation process.
